By downloading or using the application, these terms will automatically apply to you:
- Therefore, you must ensure that you read them carefully before using the application.
- You are not allowed to copy or modify the application, any part of the application, or our trademarks in any way.
- You are not allowed to attempt to extract the source code of the application, nor should you attempt to translate the application into other languages or create derivative versions.
- The application itself, as well as all trademarks, copyrights, database rights, and other intellectual property rights related thereto, are owned by Studio Pitaya SARL.
Studio Pitaya is committed to ensuring that the application is as useful and effective as possible. For thisreason, we reserve the right to make changes to the application or charge for its services at any time and for anyreason. We will not charge you for the application or its services without clearly explaining what you are payingfor.
The Gifted application stores and processes the personal data you provide to us to provide our service. Itis your responsibility to protect your phone and access to the application. We therefore recommend that you do notjailbreak or root your phone, which is the process of removing software restrictions and limitations imposed by yourdevice's official operating system. This could make your phone vulnerable to malware/viruses/malicious programs,compromise your phone's security features, and could mean that the Gifted application will not work properly or atall.
Please note that there are certain things for which Studio Pitaya cannot be held responsible. Some featuresof the application require an active internet connection. Studio Pitaya cannot be held responsible for applicationmalfunctions due to a lack of access to a stable internet connection.
If you use the application outside of aWi-Fi zone, please remember that the terms of your agreement with your mobile network provider will still apply.Therefore, your mobile network operator may charge you for data usage while accessing the application, or other third-partycharges. By using the application, you take responsibility for these charges, including roaming data charges if youuse the application outside your home territory (i.e., your region or country) without disabling data roaming. If youare not the bill payer for the device on which you are using the application, please be aware that we assume you havereceived permission from the bill payer to use the application.
Studio Pitaya is not responsible for how you usethe application: please keep your device charged or with sufficient battery power to ensure uninterrupted service.Unexpected disconnections may damage your device and the running application.
To ensure optimal use of theapplication, we update it regularly. We rely on third parties to provide us with information so that we can make itavailable to you. Studio Pitaya is not liable for any loss, direct or indirect, that you may incur by relying solely onthis functionality of the application.
Application Update Framework: The application is currently available onAndroid and iOS. The requirements for these two systems, and for any additional systems to which we decide to extend theapp's availability, may change. You will then need to download the necessary updates to continue using the app. StudioPitaya cannot guarantee that the app will be automatically updated through your device. You agree to always accept appupdates when offered. We may also wish to terminate access to the app and end your use of it at any time without noticeof termination. Unless otherwise stated by us, upon termination, (a) the rights and licenses granted to you under theseterms will end; (b) you must stop using the app and (if necessary) delete it from your device.
Changes to these Terms and Conditions
We may update our Terms and Conditions from time to time. Therefore, youare advised to check this page periodically for any changes. We will inform you of any changes by posting the new termsand conditions on this page.
